TERMS AND CONDITIONS OF ONLINE SALE

 

1. Subject
These General Terms and Conditions of sale ("general conditions") govern the online sale of products through the electronic commerce service on the website www.jewelsforplanet.com to consumer subjects of Products ("Customer"), governed in particular by Legislative Decree no. 206/2005 ("Consumer Code") and Legislative Decree no. 70/2003.
The electronic commerce service is offered by Metajewels srl headquartered in Vicenza (VI) via Vecchia Ferriera 70 at Voice of Gold, registered with the Vicenza Companies Register, registration number, VAT number, and tax code 04429850243.

Metajewels srl does not deliver Products to countries other than those indicated. Not all Products may be available for purchase in the visitor's country. The acceptance of the conditions by the customer is essential for the completion of the product purchase procedure.

2. General Conditions
2.1 The General Conditions applicable to the sale of Products on the Site are those published on the Site in the "General Conditions" section at the time of sending the Purchase Order by the Registered Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase process and to fully accept the general and payment conditions transcribed below.
2.2 Once the online purchase procedure is completed, the Customer will print or save an electronic copy and, in any case, keep these general sales conditions, in compliance with the Consumer Code (Legislative Decree 206/05) on distance sales.

2.3 These General Conditions may be modified at any time. The version of the General Conditions published at the time of the conclusion of the Contract will be binding between the Parties. Metajewels srl cannot in any case be bound by conditions sent by the Customer or different from these. Prices, Products on the Site, and their characteristics are subject to change without notice.

2.4 These General Conditions do not govern the sale of products and/or the provision of services by subjects other than Metajewels srl or Jewels for the planet present on the Site through links, banners, or other hypertext links. Before carrying out commercial transactions with such subjects, it is necessary for the Customer to verify their sales conditions. Metajewels is not responsible in any way for the provision of services and/or the sale of products by such subjects. On websites accessible through such links, Metajewels does not carry out any control and/or monitoring. Metajewels is not responsible for the content of such sites or for any errors and/or omissions and/or violations of the law by them.

3. Site Registration
3.1 To make a purchase, the Customer must register on the website www.jewelsforplanet.com, access the dedicated reserved area with their Credentials, providing an email address and a password for login, after reading the Information regarding the processing of personal data. The Customer chooses the Product to purchase and enters it into the appropriate section of the Site "Cart," where the characteristics of the Products, the price, the applicable VAT, and shipping costs will be displayed.
3.2 The registration credentials, which can be modified by the Registered Customer at any time by accessing their Jewels for Planet Account, are personal and cannot be transferred to third parties. Site registration is free.

3.2. The Customer must complete the registration procedure on the Site, even at a later time than registration but at least before sending their first Purchase Order on the Site, by accessing their Jewels for Planet Account and providing the required information and personal data.

3.3 The Registered Customer guarantees that the information provided during the Site registration process is complete, correct, and truthful. The user agrees to hold Metajewels srl harmless from any compensation obligation, sanction arising, and/or in any way connected to the violation by the Registered Customer of the rules on Site registration. All operations carried out using the registration credentials are considered carried out by the Registered Customer to whom the registration credentials refer.

3.4 With the order, the Customer expressly consents to the use of email, phone, and address by Metajewels srl in relation to the conclusion and execution of the contract.

3.5 The Registered Customer can view the Orders placed in their Jewels for Planet Account, as well as manage and save personal data.

3.6 By registering on the Site, the Registered Customer may agree to receive, through the provided contacts, any invitations to participate in sales and commercial proposals from Jewels for Planet. At any time, by clicking on the appropriate link at the bottom of the invitation, the Registered Customer can request not to receive further invitations to participate in sales.

3.7 The registered Customer can cancel their registration on the Site at any time by sending an email to the addresses info@metajewels.it.

4. Purchase Procedure and Contract Conclusion
4.1 The Customer can access the Site and view the Products for sale on the same Site, learn about the characteristics and price of the Products (expressed in Euros and inclusive of VAT), shipping, and delivery costs; the Customer can also view the photographs of the Products, published solely for the purpose of illustrating the Products themselves.
4.2 Metajewels srl will send the Customer an order confirmation email, containing the sales conditions and the order placed. The Customer's order and the order confirmation with the applicable General Conditions are electronically stored.

4.3 The sale contract of the Product is considered concluded when Metajewels srl receives payment from the Customer.

4.4 The validity of the contract is subject to the availability of the Product. If the Product is no longer available, Metajewels srl will inform the Customer within 20 days of receiving the Order and reserves the right to terminate the sales contract, refunding the entire amount paid by the Customer, without any further charge or obligation to Metajewels srl.

4.5 The Customer must carefully check the correctness of the data contained in the Order Confirmation and inform Metajewels srl of any corrections within 24 hours of receiving it.

4.6. The Purchase Order has an order number to which to refer for any communication related to the same Purchase Order.

4.7 Where the Customer has a Discount Code, they can obtain a discount on the Product price as indicated on the Site; the discount is limited to the Product price and does not apply to shipping costs. The Discount Code can be received by the Customer through the contacts provided by them in accordance with this Contract as part of promotional and advertising campaigns conducted by Jewels for planet or other methods specified by Jewels for planet through the Site (e.g., newsletter subscription). The communication with which the Registered Customer receives the Discount Code indicates, from time to time, whether i) the Discount Code has an expiration date beyond which it can no longer be used and ii) whether the Discount Code entitles to a fixed or percentage discount.

4.8 Where the customer requests a customized product, not available on the web site, Metajewels srl will communicate to the customer the production time and shipping time depending on the product. Metajewels will not be held responsible for any delays due to raw materials supplied by third parties.

5. Payment Methods
5.1 For the payment of the Product price and the related shipping and delivery costs, you can follow one of the methods indicated on the website www.jewelsforplanet.it, summarized below:
Advance bank transfer of the entire Product price,
Within 5 (five) days of receiving the Acceptance, then, the transfer must be made by the Registered Customer to the following bank details:

The Registered Customer must send the bank transfer receipt to the email address info@metajewels.it, indicating the Order number assigned in the Order Confirmation. In the event that Metajewels srl does not receive within 5 days of the Order Confirmation the bank transfer receipt sent to the email address info@metajewels.it, the Order is considered automatically canceled.

Credit card
In the event that the purchase is made through the payment method by credit card, at the same time as the conclusion of the online transaction, the reference bank will authorize the credit card charge for the amount indicated in the order. The credit card is debited when the Customer receives the order confirmation email.

Paypal
In case of purchase through the Paypal payment method, the Customer must have a Paypal account. The amount due is debited from the Paypal account when the order is confirmed.

6. Shipping and Delivery of Products
6.1 The Products purchased on the Site are delivered to the address indicated by the Customer in the Purchase Order.
6.2 Metajewels srl ships the Products through couriers specialized in the delivery of high-value goods. The Products are generally delivered within 48 hours of the order confirmation, with the exception of non-mainland locations. For more information on delivery times, the Customer can refer to the "Shipping" section of the Site.

6.3 Metajewels srl cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the Purchase Order by the Customer.

6.4 Metajewels srl will not be liable for any delays in delivery attributable to the courier. The Customer can check the status of the shipment directly on the courier's website using the tracking code provided by Metajewels srl.

6.5 Metajewels srl, through its carriers, delivers from Monday to Friday, excluding holidays.

7. Right of Withdrawal and Product Returns
7.1 The Customer has the right to withdraw from the contract without specifying the reason, within 14 days from the day the Product is received.
7.2  The Customer must inform Metajewels srl by explicitly declaring the lack of conformity by registered letter within two months from the discover of the lack of conformity. Within Two years from the delivery date Metajewels is responsable for the lack of conformity.

7.3  The legal garanty of conformity apply only to lack that are not included in the use of the product. Repaired, modified or altered products are not included in the Garanty. Also failure and malfunction are escluded. Furthermore are escluded from the Garanty defects to to the accidental use or due to the responsability of the Rgistered Customer due to the use of the prodoct not in line with the proper use and different from the technical documentation with the product, when available, or in the Method of use of the product. 

Under no circumstances can Metajewels srl be held responsible for failure to fulfill any of the obligations deriving from the Contracts subject to these General Conditions in the event that the failure is caused by unforeseeable circumstances and/or force majeure, including, by way of example only, natural disasters, terrorist acts, network malfunctions and/or blackouts.

The liability of Metajewels srl, in any case, cannot exceed the total value of the Purchase Order.

8. Withdrawal
8.1.
Pursuant to the articles. 52 et seq. of the Consumer Code, the Customer who qualifies as a "consumer" pursuant to the Consumer Code has the right to withdraw from the Contract at his discretion, without any penalty and without specifying the reason, within 14 (fourteen) days starting from the day of delivery of the Products. Full proof of receipt is the Forwarder's delivery note or the Order delivery document.

8.2 In relation to the Products delivered by the Forwarder pursuant to the previous article 6.(i), the withdrawal may be exercised using, by choice, one of the following methods:

- giving notice of withdrawal by registered letter with acknowledgment of receipt sent to Metajewels srl, to the following address:

The communication must include as an attachment a copy of the withdrawal form, which can be downloaded from this link and duly completed. The withdrawal may also be anticipated by email to the email address info@metajewels.it provided that the communication of withdrawal is confirmed by registered letter with acknowledgment of receipt within the following 48 hours
- if you have a certified email account (PEC), simply write to info@pec.metajewels.it. The communication must include as an attachment a copy of the withdrawal form, which can be downloaded from this link and duly completed.
As required by current legislation, emails sent from a PEC account have the value of registered mail.

9. Content
9.1. The Content of the Site is protected by copyright and any other intellectual property rights of Metajewels srl and other rights holders. The reproduction, modification, duplication, copying, distribution, sale or in any case exploitation of the Site Content is prohibited unless previously authorized in writing by Metajewels srl or the authorized parties. Any use of the contents of the Site for commercial and/or advertising purposes is also prohibited.

9.2. All other trademarks, distinctive signs, images, models that distinguish the Products sold on the Site or in any case connected to them, registered by their respective owners or in any case subject to proprietary rights by third parties, are used by Metajewels for the sole purpose of distinguishing and describe the Products for sale on the Site.

Any use of the brands, distinctive signs, images and models mentioned above by the user of the Site or by anyone else that does not comply with the law is prohibited.

9.3. Under no circumstances may the user alter, change, modify or adapt the Site or its Content.

10. Protection of personal data
10.1. Metajewels srl is the owner of the personal data collected when registering on the Site, as well as those subsequently communicated when the Purchase Order is sent by the Registered Customer.
For information relating to the processing of personal data, including the rights referred to in the art. 15-16-17-18-20 of EU Reg. 2016/679, please refer to the detailed privacy information (Privacy Policy) available on the Site and accepted by the Registered Customer at the time of registration on the Site itself.
